Welcome to Local Pastures! The terms “we”, “us” and “our” refer to Local Pastures. Local Pastures operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Local Pastures is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Section 1 – Access and Account
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
Section 2 – Our Products
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ due to device display settings, and Local Pastures makes no warranty as to visual accuracy.
All of our meat products are sourced from local, inspected farms and delivered frozen or pre-packaged. Because we work with small local producers, product availability may vary by season. We may substitute comparable cuts when necessary.
All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities to any person, geographic region or jurisdiction.
Section 3 – Orders
When you place an order, you are making an offer to purchase. Local Pastures reserves the right to accept or decline your order for any reason. Your order is not accepted until Local Pastures confirms acceptance and receives and processes your payment.
Subscription orders are billed on a recurring basis until paused or canceled by the customer. You must cancel or pause before your next billing date to avoid renewal. Due to the perishable nature of our products, we may be unable to accommodate cancellation requests after an order is accepted.
Local Pastures reserves the right to refuse service to anyone for any reason at any time.
Your purchases are subject to our Cancellation Policy. You represent and warrant that your purchases are for personal or household use and not for resale.
Section 4 – Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed. Unless otherwise stated, posted prices do not include taxes or delivery fees.
In the event of a pricing error, Local Pastures reserves the right to cancel or refuse any orders placed at an incorrect price, even if the order has been confirmed. If this occurs, you will be notified and refunded in full.
Subscription orders renew automatically until paused or canceled. Customers are responsible for managing subscriptions prior to the billing date. You agree to provide current, complete and accurate payment information for all purchases and to promptly update account details.
Section 5 – Shipping and Delivery
Local Pastures offers delivery only within designated Chicago ZIP codes listed on our website. You must provide accurate delivery information and ensure a safe and accessible location for drop-off. Title and risk of loss transfer upon delivery. Local Pastures is not responsible for missed deliveries, delays, or spoilage due to inaccurate information or unsafe delivery locations.
Section 6 – Reuseable Packaging
Orders may be delivered in reusable insulated bags to maintain food safety. Customers agree to return reusable bags at the next delivery. A replacement fee may be charged for unreturned bags.
Section 7 – Food Safety
Our meat products are raised on local farms and processed, packaged, and labeled by licensed and inspected processors. Products are delivered frozen or in their original processor-applied packaging. Local Pastures cannot be responsible for illness, injury, or damages resulting from improper storage, handling, or cooking after delivery, nor for farming or processing practices outside of our direct control. Once delivery is made, you assume full responsibility for proper storage, handling, and preparation.
Allergen Disclaimer: Our products may contain or come into contact with common allergens, including but not limited to wheat, soy, dairy, eggs, peanuts, tree nuts, and shellfish. By purchasing, you acknowledge and accept this risk.
No Medical Guarantees: Local Pastures does not warrant that products are suitable for any particular diet or health condition. Customers are responsible for reviewing ingredients and consulting with a medical professional if necessary.
Regulatory Compliance: All meat products are sourced from farms and processors inspected under applicable federal and state regulations. Local Pastures is not liable for practices outside its control, including on-farm production methods or third-party packaging.
Section 8 - Intellectual Property
Our Services, including trademarks, text, images, and other content, are owned by Local Pastures or its licensors and protected by law. These Terms permit personal, non-commercial use only. Unauthorized use is prohibited. All rights not expressly granted are reserved by Local Pastures.
Section 9 - Mobile Terms of Service
The Local Pastures mobile message service (the "Service") is operated by Local Pastures (“Local Pastures”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Local Pastures’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Local Pastures through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Local Pastures. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +1(312) 465-4688 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Local Pastures mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Section 10 - Optional Tools
You may be provided with access to optional third-party tools. These are provided 'as is' and 'as available'. We have no liability arising from your use of such tools. Any use is at your own risk and subject to the third-party provider’s terms.

The Services may include links to third-party websites. We are not responsible for the content, accuracy, or practices of third parties. Accessing third-party sites is at your own risk.
Section 12 - Relationship With Shopify
Local Pastures is powered by Shopify, which enables us to provide Services. Sales and purchases are made directly with Local Pastures. By using the Services, you acknowledge Shopify is not responsible for any sales, claims, or damages related to transactions with Local Pastures.
Section 13 - Privacy Policy
All personal information is collected in accordance with our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read and agree to these policies.
You acknowledge that your content (excluding payment credentials) may be transferred unencrypted and adapted to technical requirements for transmission or display.
Section 14 – Feedback
If you submit feedback, you grant us a perpetual, royalty-free license to use it for business purposes. You represent you have rights to the feedback and that it does not infringe on third-party rights.
Section 15 - Errors, Inaccuracies, and Omissions
We may occasionally provide information with errors, inaccuracies, or omissions, including descriptions, pricing, promotions, offers, or availability. We reserve the right to correct such errors, update information, or cancel orders if any information is inaccurate, at any time, without notice. Any reliance on information on the Site is at your own risk. Historical information may not be current, and Local Pastures has no obligation to update information except as required by law.

We may modify, suspend, or discontinue any part of the Services, including subscription offerings, at any time without notice. Local Pastures shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
Section 17 - Prohibited Uses
You may use the Services for lawful purposes only. You may not use the Services in violation of law, infringe on intellectual property, transmit harmful content, or otherwise misuse the Services. Violations may result in suspension or termination.
Section 18 – Termination
We may terminate your access to the Services at any time, without notice, if you violate these Terms. The limited license granted herein automatically terminates if you breach any provision of these Terms. All provisions intended to survive termination will remain in effect.
Section 19 - Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED, THE SERVICES AND PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE'. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free service.
Food-Specific Disclaimer: All food products are sold 'as-is' due to their perishable nature. Local Pastures makes no warranties regarding freshness or suitability once products have been delivered.
Section 20 - Limitation of Liability
To the fullest extent permitted by law, Local Pastures’ liability is limited to the purchase price paid for your order. We are not liable for indirect, incidental, punitive, or consequential damages arising from the use of our Services or products.
Section 21 – Indemnification
You agree to indemnify and hold harmless Local Pastures, Shopify, and their affiliates, officers, employees, and contractors from claims, damages, or losses arising from your violation of these Terms, your unlawful conduct, or your use of the Services.
Section 22 – Severability
If any provision is found unlawful or unenforceable, it shall be severed without affecting the validity of the remaining provisions.
Section 23 – Waiver; Entire Agreement
Failure to enforce any right does not waive it. These Terms, along with referenced policies, constitute the entire agreement between you and Local Pastures.
Section 24 – Assignment
You may not assign or transfer these Terms without our prior written consent. Local Pastures may assign these Terms without restriction.
Section 25 - Governing Law
These Terms are governed by the laws of the State of Illinois. Any disputes shall be resolved exclusively in the state or federal courts of Cook County, Illinois.

Headings are for convenience only and do not limit or affect these Terms.
Section 27 - Changes To Terms of Service
We may update or modify these Terms at any time by posting updates on our website. It is your responsibility to review changes. Continued use of Services constitutes acceptance of changes.
